CONNECTICUT - The Doctor Lawyer Team, a law firm representing military members in lawsuits nationwide, comments on the efforts of U.S. Senator Mullin and U.S. Congressman Hudson to demand accountability for U.S. service members who have been victims of Department of Defense (DoD) medical malpractice. The DoD has failed to abide by a 2019 law Mullin and Hudson helped to pass to better protect soldiers from poor medical care.
Dr. Michael Giordano and Attorney Paul McConnell, partners and veteran owners of The Doctor Lawyer Team, have seen firsthand how the lack of accountability has left service members vulnerable to medical negligence or malpractice while serving their country. “We are proud that our elected officials are standing up and trying to enact important changes to laws that have historically harmed our country’s service men and women," said McConnell and Giordano in a joint statement, "Our service members put their lives on the line every day, and they deserve the best medical care available. If they are harmed from negligence, they deserve the same opportunities to recover as the people they protect."
In 2019, Senator Mullin and Congressman Hudson co-sponsored a bill to improve healthcare quality within the DoD. With this legislation, they intended to hold military medical personnel accountable for negligent acts committed while treating service members under their care. However, the DoD’s implementation of this law has been slow and inadequate.
“When our men and women in uniform make the brave decision to serve our country, they should know that we will take care of them and have their backs,” said Senator Mullin during a press conference on March 29, 2023. “What happened to SFC Richard Stayskal and so many others is a tragedy. We know that of the 155 medical malpractice claims that have been processed, 144 have been denied, and that’s just within the Army. That’s a serious problem. The DoD has repeatedly failed in its basic obligation to protect our service members, and they are liable.”
Congressman Hudson echoed these sentiments saying, “Rich Stayskal is my constituent. He’s my neighbor. He and Megan and the girls have become my friends. I was devastated when I heard this result from DoD. What happened to Rich Stayskal with this misdiagnosis and malpractice is unforgivable and an American tragedy. It’s compounded by the fact that, just like 144 heroes who have applied for relief, they have been denied. These folks kept their promise to us, they served honorably, and they deserve the best we have to offer them, and that’s not what they’re getting.”
